Almost everyday an auditor or inspector visits a pharmacy or pharmacies in Florida to conduct a provider audit or a pharmacy inspection. The auditors examine pharmacy records for fraud and abuse of the healthcare program. The inspectors inspect the pharmacy and its records re: pharmacy laws and rules issues. Recently an inspector in a routine inspection of a pharmacy, advised the pharmacist present that they had to obtain a permit to sell oxygen in the pharmacy. The law FS 499.0122 reads as follows: Medical oxygen retail establishment means a person licensed to sell medical oxygen to patients only. The sale must be based on an order from a practitioner authorized by law to prescribe. The term does not include a pharmacy licensed under Chapter 465 (our pharmacy practice act).
